Welcome to ABA Career Hub (“Platform,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, services, and features connecting employers and job seekers in the Applied Behavior Analysis (ABA) field.

By accessing or using the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.

1. Eligibility & Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, complete, and current information
  • Maintain the security of your login credentials
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts at our discretion.

2. Platform Purpose

ABA Career Hub is a job board designed to connect ABA professionals (e.g., BCBAs, RBTs, BTs) with employers.

We are not a staffing agency, employer, or agent for either party.

3. Paid Services (Job Postings & Subscriptions)

3.1 Job Posting Fees

Employers may pay to post job listings. By purchasing a job posting, you agree that:

  • Fees are clearly displayed at checkout
  • Listings will remain active for the specified duration
  • We do not guarantee applications, hires, or performance

3.2 Subscription Plans

We may offer subscription-based services (e.g., recurring job postings, featured listings).

By subscribing, you agree that:

  • Billing will recur automatically based on your selected plan
  • You authorize us to charge your payment method on file
  • You may cancel at any time, but no partial refunds will be issued for unused time

3.3 Price Changes

We reserve the right to modify pricing at any time. Changes will not affect active paid periods but will apply to future purchases or renewals.

4. Refund Policy

All payments are non-refundable, except:

  • Duplicate charges
  • Technical errors caused by the Platform
  • Cases where a job post fails to go live due to our error

5. Employer Responsibilities

By posting jobs, you agree that:

  • All listings are accurate, lawful, and non-discriminatory
  • You comply with all federal, state, and local employment laws
  • You have authority to post on behalf of your organization

You are solely responsible for your job postings and hiring practices.

6. Job Seeker Responsibilities

By using the Platform, job seekers agree to:

  • Provide truthful and accurate application materials
  • Apply only for legitimate opportunities

ABA Career Hub is not responsible for hiring decisions, employer conduct, or job outcomes.

7. User Content

You retain ownership of any content you submit (resumes, job listings, etc.).

By submitting content, you grant ABA Career Hub a worldwide, non-exclusive, royalty-free license to:

  • Use, display, and distribute your content
  • Promote the Platform
  • Improve our services

8. Prohibited Activities

You agree not to:

  • Post false, misleading, or fraudulent information
  • Discriminate based on protected characteristics
  • Harass or harm other users
  • Use bots, scraping tools, or automation
  • Attempt unauthorized system access

We reserve the right to remove content or ban users at our discretion.

9. Privacy

Your use of the Platform is subject to our Privacy Policy.

We do not guarantee confidentiality of information shared with employers or applicants.

10. No Guarantee of Results

We do not guarantee:

  • Job placement for candidates
  • Qualified applicants for employers
  • Accuracy of listings or user content

Users must conduct their own due diligence.

11. Platform Availability

We may:

  • Modify or discontinue features at any time
  • Interrupt service for maintenance or updates

We are not liable for downtime or service interruptions.

12. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

We disclaim all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

13. Limitation of Liability

To the fullest extent permitted by law, ABA Career Hub shall not be liable for:

  • Indirect or consequential damages
  • Lost revenue, profits, or hiring outcomes
  • User interactions or disputes

14. Indemnification

You agree to indemnify and hold harmless ABA Career Hub from any claims arising from:

  • Your use of the Platform
  • Your job postings or applications
  • Your violation of these Terms or laws

15. Governing Law

These Terms are governed by the laws of the State of New York.

All disputes will be resolved in courts located in that state.

16. Changes to Terms

We may update these Terms at any time. Continued use of the Platform means you accept the updated Terms.
